U.S. Customs announces Full ISF Enforcement as of July 9, 2013
 
 
 
Dear Customer,
 
 
U.S. Customs & Border Protection (CBP) has announced they will apply existing liquidated damage provisions to ISFs required to be filed on or after July 9, 2013. 
 
CBP stressed that every liquidated damage enforcement action instituted by a port will be reviewed by CBP headquarters before issuance.   It does not appear that enforcement actions will apply to ISF-5 filings which are required for in-transit goods.  This includes freight remaining on board cargo. 
 
Until this point, CBP has applied a "measured and commonsense approach to ISF enforcement", with only increased exams and cargo holds at destination.   In this new phase, there may be penalties issued - which are generally $5000 per occurrence prior to any mitigation.   DGF can provide mitigation petitions for our customers as an ancillary service.
 
During the next 30 days importers should notify their suppliers of this change in enforcement approach for US discharged ocean freight, and reiterate the pre-sailing notification requirement to the ISF filer.  If there are any questions about ISF notifications when DHL is the filer, please contact ben.english@dhl.com.
